Salary Sacrifice Request Deed of Undertaking - Novated Lease

The Employee hereby enters into this Deed of Undertaking:

  1. I undertake that I have read and understood the information provided by all parties regarding salary sacrifice for a Novated Lease, including but not limited to:
    1. The terms of, and my obligations under, the Lease.
    2. The terms of, and my obligations under, the Novated Lease.
    3. Any changes to the Novated Lease must be made in writing to the Employer.

  2. I agree and acknowledge that due to my casual employment with the Employer, during periods when I am taking leave or not working, the Employer will continue to be obliged to pay monthly instalments to the Financier, but may not be able to deduct those amounts from my wage by way of salary sacrifice.

  3. In the event that the Employer makes a monthly instalment payment to the Financier, but I am not being paid at that time due to approved leave:
    1. I acknowledge that I will owe a debt to the Employer for that monthly instalment (the "Debt").
    2. I undertake to repay that Debt as soon as possible to the Employer, and acknowledge the Novated Lease is not intended to cause the Employer to incur a debt on my behalf.
    3. I authorise the Employer to recover the Debt by full deduction from my next pay, or as otherwise agreed in writing.

  4. If I wish to terminate the Novated Lease, or if my employment ends:
    1. If I am terminating the Novated Lease, I must submit a written request to the Employer at least 30 days prior to the intended termination date.
    2. If my employment ends, I undertake to promptly contact the Financier to arrange for the termination of the Lease and Novated Lease to prevent further payments by the Employer.
    3. Reconciliation of funds will be finalised, and any held balance will be either paid out or returned to payroll as determined by the Employer.
    4. If my employment ends before the full amount can be salary sacrificed, I undertake to repay any outstanding debt to the Employer as soon as possible.

  5. If the Employer is required to recover any outstanding debt related to the Novated Lease, and that debt remains unpaid for more than 60 days:
    1. I will not file a defence to any legal proceedings brought by the Employer.
    2. The Employer may rely on this Undertaking in seeking repayment orders.
    3. I will be responsible for any legal costs the Employer incurs in pursuing the debt.

  6. I agree and acknowledge that under the Novated Lease, the Employer does not indemnify me for any losses incurred as a result of the Lease or Novated Lease.

  7. I undertake to:
    1. Reimburse Recruitment Hive for any Fringe Benefits Tax (FBT) liability or penalty arising from the Lease and/or Novated Lease.
    2. Indemnify the Employer against all direct or indirect losses and liabilities related to the Novated Lease entered into for my benefit.

  8. I agree and acknowledge that:
    1. Any information provided by the Employer is not financial or taxation advice.
    2. I have not relied, and will not rely, on the Employer’s information as financial or taxation advice.
    3. The Employer has advised me to seek independent financial advice regarding the Lease and Novated Lease.
    4. If I incur additional tax or other costs related to the Lease or Novated Lease, they are my personal responsibility, and I will not hold the Employer liable.

  9. By executing this Deed of Undertaking, I:
    1. Confirm that I have reviewed the Lease, the Novated Lease, and this Deed, and that the information is accurate.
    2. Authorize the Employer to implement the requested salary sacrifice arrangement in accordance with the Novated Lease and this Deed.

Superannuation Salary Sacrifice Agreement

This Agreement outlines the terms under which I (“The Employee”), [Full Name], as an employee of Recruitment Hive (“The Employer”), will make additional contributions to my superannuation fund through salary sacrifice.

Superannuation Fund

  • The Employee's salary sacrifice superannuation contributions will be paid into their nominated superannuation fund, using the identical fund details recorded in Astute.

Salary Sacrifice Amount

  • The Employee requests to contribute the following amount from their pre-tax salary to their nominated superannuation fund:
  • Amount: $[Amount] per pay period, or [Percentage]% of gross salary per pay period.

Frequency of Sacrifice

  • The salary sacrifice deduction will align with the employee’s regular pay cycle and be paid to the employee’s nominated superannuation fund concurrently with the employer contributions.

Commencement Date

  • This Agreement will commence from [Start Date].
  • This Agreement will end at [End Date].
  • I (the employee) wish to keep this Agreement as an ongoing agreement until my notice: [Yes/No].

Variation and Termination

  • This Agreement can be varied by written agreement between the Employer and the Employee.
  • The Employee may terminate this Agreement by providing one month written notice to the Employer.
  • The Employer may terminate this Agreement in accordance with the relevant company policy.

Employee Acknowledgement

  • I voluntarily entered into this salary sacrifice arrangement.
  • I understand that the sacrificed amount will be paid into my nominated superannuation fund and is subject to the rules and regulations of that fund and relevant superannuation legislation.
  • I have sought my own independent financial advice regarding this salary sacrifice and its suitability for my circumstances.
  • I confirm the accuracy of the information provided and authorize The Recruitment Hive Pty Ltd to implement this request.
  • I acknowledge that it is my obligation to ensure this salary sacrificing arrangement does not breach the Concessional Contributions Cap.
  • I understand that breaching the Concessional Contributions Cap will result in an excessive tax liability, levied at my marginal tax rate by the Australian Taxation Office.

Work Related Equipment and Otherwise Deductible Items Terms of Service

I declare the following:

  • The above expense(s) is directly related to my work and is a legitimate expenditure of mine.
  • Only one item with a substantially identical function (unless it is a replacement item) has been claimed per FBT year.
  • I acknowledge the information provided by Recruitment Hive does not constitute financial or taxation advice. Recruitment Hive recommends that I seek independent financial advice.
  • Recruitment Hive accepts no liability should I incur additional income tax or other costs, now or in the future, due to this salary sacrifice claim. I agree to reimburse Recruitment Hive the full cost of any Fringe Benefits Tax liability or penalty resulting from this salary sacrifice claim.

Note: This should not be claimed again in your personal income tax return, as the ATO would consider it to be double-dipping.

LAFHA Terms of Service

  • The information I have provided in this checklist is true and accurate.
  • I acknowledge the information provided by Recruitment Hive does not constitute financial or taxation advice. Recruitment Hive recommends that I seek independent financial advice.
  • I understand that any changes to the Living-away-from-home allowance must be made in writing to Recruitment Hive. Employee (Applicant) withdrawal from the Living-away-from-home allowance must be made in writing to Recruitment Hive giving 30 days’ notice.
  • Recruitment Hive accepts no liability should I incur additional income tax or other costs, now or in the future, due to this salary sacrifice claim. I agree to reimburse Recruitment Hive the full cost of any Fringe Benefits Tax liability or penalty resulting from this salary sacrifice claim.

Note: This should not be claimed again in your personal income tax return, as the ATO would consider it to be double-dipping.

Banked Hours Program Terms of Service

Declaration

I declare the following:

  • I voluntarily entered into this Banked Hours Program.
  • I have sought my own independent financial advice regarding this Program and its suitability for my circumstances.
  • I confirm the accuracy of the information provided and authorize The Recruitment Hive Pty Ltd to implement this request.
  • I agree and understand that this program does not in any way alter the fundamental terms of my employment contract.
  • I understand that access to this program may be varied by mutual agreement in writing between The Recruitment Hive Pty Ltd and the Employee (me).
  • I acknowledge and agree that it is my obligation to withdraw all banked hours before the conclusion of the current financial year. Should any balance remain, The Recruitment Hive Pty Ltd will automatically process and disburse the outstanding hours prior to the financial year-end to me without any notice.
  • The Recruitment Hive Pty Ltd may terminate the Employee's (me) access to this program by providing 2 weeks' written notice to the Employee (me).
  • The Employee (me) may leave this program by providing 2 weeks' written notice to The Recruitment Hive Pty Ltd.
  • Upon termination of access to this program, any outstanding balance of banked hours will be paid out to the Employee in the next pay period following the termination date, at the Employee's ordinary rate of pay.
