  1. I undertake that I have read and understood the information provided by all parties regarding salary sacrifice for a Novated Lease, including but not limited to:

    1. The terms of, and my obligations under, the Lease.

    2. The terms of, and my obligations under, the Novated Lease.

    3. Any changes to the Novated Lease must be made in writing to the Employer.





  2. I agree and acknowledge that due to my casual employment with the Employer, during periods when I am taking leave or not otherwise working, the Employer will continue to be obliged to pay monthly instalments to the Financier, but may not be able to deduct those amounts from my wage by way of salary sacrifice.



  3. In the event that the Employer makes a monthly instalment payment to the Financier, but at the relevant time I am not being paid due to approved leave and therefore the amount cannot be deducted from my salary:

    1. I acknowledge that I will owe a debt to the Employer for that monthly instalment (Debt).

    2. I undertake to repay that Debt as soon as possible to the Employer, and that the intent of the Novated Lease is not for the Employer to incur a debt on my behalf without deduction from my wage.

    3. I authorise the Employer to repay the Debt by way of full payment over the next pay following the date the Debt was incurred or as otherwise agreed in writing.





  4. If I want to terminate the Novated Lease, or my employment with the Employer ends:

    1. I agree that if I am terminating the Novated Lease, I must make a request in writing to the Employer with at least 30 days’ notice of the proposed termination date.

    2. If my employment with the Employer ends, I undertake to contact the Financier as soon as possible to arrange the termination of the Lease and the Novated Lease, so that no further lease payments are made by the Employer after my employment ends.

    3. Reconciliation of funds will be finalised, and any held balance will be either paid out or returned to payroll as determined by the Employer.

    4. If my employment ends before the full amount is able to be salary sacrificed, I undertake to repay any outstanding debt owed to the Employer as soon as possible.





  5. I agree that if the Employer is required to pursue repayment of any debt owed to it by me under the Novated Lease and it is outstanding for more than 60 days, and the Employer commences proceedings to recover the debt:

    1. I will not file any defence to such a claim.

    2. The Employer can rely on this Undertaking in seeking orders for repayment.

    3. I will be liable to pay the Employer’s costs incurred as a result of any recovery action.





  6. I agree and acknowledge that under the Novated Lease, the Employer does not indemnify me in relation to any losses I might incur as a result of the Lease or the Novated Lease.



  7. I undertake to:

    1. Reimburse the Employer the full cost of any Fringe Benefits Tax liability or penalty resulting from the Lease and/or the Novated Lease.

    2. Indemnify the Employer against all losses and liabilities incurred directly or indirectly as a result of the Employer entering into the Novated Lease for my benefit.





  8. I agree and acknowledge that:

    1. Any information provided to me by the Employer regarding the Novated Lease and any salary sacrificing arrangements is not financial or taxation advice.

    2. I have not and will not rely on the information provided by the Employer as financial or taxation advice.

    3. The Employer has recommended that I seek independent financial advice in relation to the Lease and Novated Lease.

    4. If I incur additional income tax or other costs, now or in the future, as a result of the Lease or the Novated Lease, that will be my personal liability and I will not make any claim that the Employer is partly or wholly responsible for those costs.





  9. By executing this Deed of Undertaking, you:

    • Agree that you have reviewed the Lease, the Novated Lease, and this Deed, and that the information is accurate; and

    • Authorise the Employer to implement the requested salary sacrifice arrangement in accordance with the Novated Lease and this Deed.
